About PhotoAppMaker

General Information

PhotoAppMaker was developed by Marc Rochkind, developer of ImageIngester and other photographic applications. It is designed to exploit the newest capabilities of mobile devices such as iPhone, iPod Touch, iPad, and newer devices running the Android system.

PhotoApps run on some non-mobile systems (running Firefox or Safari browsers, for example), but they are not optimized for non-touchscreen devices.

THIS SOFTWARE IS PROVIDED BY THE COPYRIGHT HOLDER "AS IS" AND ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED. IN NO EVENT SHALL THE COPYRIGHT OWNER OR CONTRIBUTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

Additional terms:

  1. Photos that appear in PhotoApps are the property of whoever owns them. Responsibility for their content, usage rights, and all other matters related to them rests with the customer who made the PhotoApp and not with PhotoAppMaker.com, Basepath Associates, or Marc Rochkind.
  2. We reserve the right to cancel the account of any customer and delete any or all of his or her PhotoApps if in our sole opinion usage of this site by that customer is inappropriate or excessive.
  3. Free PhotoApps are subject to being deleted at the expiration of their availability period, which is normally 90 days.
  4. We will try to preserve PhotoApps intact (subject to the availability period), but circumstances beyond our control may cause data loss. Customers are responsible for backing up their photos and other assets.
  5. The entire contents of the PhotoAppMaker site and all PhotoApp software (but not photos, other than examples) are copyrighted by Marc Rochkind and all rights are reserved.
  6. Customer agrees not to attempt or to provide assistance to anyone else to attempt to modify, copy, or reverse engineer any software on the PhotoAppMaker site or downloaded as a part of a PhotoApp. "Copy" shall not apply to downloading a PhotoApp by clicking on its URL or by saving it to a device from within a browser; these activities are legitimate.
  7. The PhotoAppMaker service, including hosting of PhotoApps, may be terminated at any time without notice. In such an event we will use our best efforts to refund unused paid credits.
  8. Customer understands and agrees to the Privacy Policy (see below).
  9. A PhotoAppMaker account may be terminated by sending an email to customer service (link at bottom). Remaining credits will be refunded at the price paid, starting with the most-recently purchased credits.
  10. No refunds will be provided for already-made PhotoApps.
  11. We have the right to change the limitations of free PhotoApps and the capabilities and price of paid PhotoApps at any time. However, if we do so, we will try to keep already-made PhotoApps intact, and we won't charge additionally for them.
  12. By registering for a PhotoAppMaker account you agree to these Terms and Conditions.

Privacy Policy

This Privacy Policy describes how personal information is collected from PhotoAppMaker customers and how that information is used and disclosed.

By registering for a PhotoAppMaker account, you consent to the terms of this Policy.

Your registration information is used only for site operation and will not be disclosed to anyone else except under court order or as otherwise required by law.

Emails may be sent to you about PhotoAppMaker or other software products or services developed or provided by Basepath Associates or Marc Rochkind, but your email address will not be disclosed to anyone else.

We will use our best efforts to protect the confidentiality of your personal information, but we are not responsible for events outside our control, such as those that might occur with our hosting provider.
